These Terms and Conditions govern all offers, sales, and deliveries made by Yakaza Metal Aluminium B.V. via the website www.kozijnenpro.nl. By placing an order, the customer accepts these conditions as binding.

3. Offer and Conclusion of Contract

3.1 All product listings and pricing on our website are non-binding and subject to technical updates or availability.
3.2 A sales contract is concluded only after the customer receives written confirmation from Yakaza Metal Aluminium B.V. following their order.
3.3 We reserve the right to reject any order without obligation to disclose reasons.

4. Product Characteristics

4.1 All products are custom-made aluminium windows and doors, manufactured according to the specifications submitted by the customer via our configurator or by written request.
4.2 Visual elements such as product images and diagrams are for illustration purposes only and may differ from the final delivered item.
4.3 Dimensional tolerances, technical deviations, and construction-related adjustments are permissible within industry norms.

5. Prices and Payment Terms

5.1 All prices are stated in Euros (€) and include 21% Dutch VAT unless expressly stated otherwise.
5.2 For deliveries outside the European Union, VAT may be refunded upon submission of official import confirmation, such as:

  • A Bill of Lading showing arrival at the destination port
  • An official customs clearance certificate

5.3 Accepted payment methods include:

  • Credit/Debit Cards (Visa, Mastercard, Maestro) via Stripe
  • Stripe Checkout for secure online payments
  • Bank Transfer to the account below:

5.4 Orders are only processed once full payment is received. Production and delivery timelines begin after this point.
5.5 In the event of late payment, Yakaza Metal Aluminium B.V. may cancel the order and claim any legally permissible interest or collection costs.

6. Production and Delivery

6.1 All products are manufactured to order. Production starts only after full payment and technical confirmation of the configuration.
6.2 Estimated production times range between 15 to 25 working days, depending on the product type, quantity, selected colors, and glazing options.
6.3 Deliveries are carried out by Discordia using:

  • Partial loading in standard trucks
  • 20-foot, 40-foot, or 40-foot High Cube (HC) shipping containers

6.4 Deliveries are curbside only. Installation, unloading, and positioning services are not included unless otherwise agreed.

7. Delivery Documentation

Yakaza Metal Aluminium B.V. provides all required export documentation, including:

  • Commercial Invoice
  • Certificate of Origin
  • Packing List
  • Country-specific or customs-specific export documents

These documents will be provided digitally and/or with the shipment.

8. Warranty and Liability

8.1 We guarantee that all products meet the agreed specifications and comply with relevant industry standards.
8.2 Visible damage or shortages must be reported within 24 hours of delivery, supported by clear photos.
8.3 Functional issues must be reported within 14 days of delivery.
8.4 Our warranty covers manufacturing defects but excludes:

  • Improper storage or handling by the customer
  • Damage caused during installation
  • Modifications or misuse after delivery

8.5 Liability is limited to product replacement or repair. Further claims, including for indirect damages, are excluded unless due to gross negligence or willful misconduct.

9. Right of Withdrawal

9.1 Under EU consumer law, the right of withdrawal does not apply to custom-made products.
9.2 All orders via kozijnenpro.nl are considered made-to-order and are therefore non-returnable and non-refundable, unless defective or delivered incorrectly.

10. Force Majeure

10.1 Yakaza Metal Aluminium B.V. shall not be held liable for delays or non-performance caused by circumstances beyond our control, including but not limited to:

  • Natural disasters
  • Transport disruptions
  • Shortages of raw materials
  • Political instability or sanctions
  • Delays in customs clearance

11. Data Protection

11.1 All customer data is processed in accordance with our Privacy Policy, available on our website.
11.2 We handle your data with the highest care and never sell or disclose it to third parties without consent, except when required for order fulfillment or legal compliance.

12. Applicable Law and Jurisdiction

12.1 All agreements and disputes are subject exclusively to Dutch law.
12.2 The place of jurisdiction is Rotterdam, The Netherlands.

13. Final Provisions

13.1 If any provision in these Terms and Conditions is deemed unenforceable, the remaining provisions shall remain valid.
13.2 Yakaza Metal Aluminium B.V. reserves the right to amend these Terms at any time. The version in effect at the time of ordering shall apply.
